CONSENT TO THE PROCESSING OF PERSONAL DATA AND PRIVACY POLICY OF THE SITE

Charitable organization "Charitable Foundation "For a Peaceful Sky", represented by director Vitaly Oleksandrovych Komarevtsev, acting on the basis of the Charter, (hereinafter - the "Charitable Organization"), on the one hand, and the Site User (hereinafter also - the "User"), which accepted and agrees to the terms of this "Agreement on the processing of personal data and the privacy policy of the Site" (hereinafter - the "Agreement"), by joining the User to the terms of this Agreement, in the manner provided for in this Agreement, the terms of which provide for the following:

1. General provisions

1.1. This Agreement was developed in accordance with the requirements of the Law of Ukraine "On the Protection of Personal Data" and other normative acts of the legislation of Ukraine, which regulate legal relations related to the collection, processing, and storage of personal data, as well as the right of citizens to non-interference in private life.
This Agreement is a public accession agreement.
1.2. When visiting the resources of this Site, the user of the Site confirms his agreement with the rules and requirements of the Agreement. If the Site User does not agree to the terms of the Agreement, he is obliged to leave the Site and refrain from visiting it in the future.
1.3. The User's consent to the terms of this Agreement involves:
1.3.1. use of any of the functions or services of the Site;  
1.3.2. registration on the Site (including through accounts in other networks); 
1.3.3. entering your data in the "Your name" and/or "Your e-mail" forms on the Site; 
1.3.4. indicating and/or instructions "I agree with the Agreement on the processing of personal data" when using the Site service.
1.4. The Site user has no right to post information, use the site, if he does not agree with this Agreement or he has not reached the legal age when he has the right to enter into agreements, or is limited in his rights in accordance with the law.
1.5. The Site User's personal data will be stored by the Charitable Organization at the address: Ukraine, 03189, city of Kyiv, str. Yaltynska, building 15, apartment 178.
1.6. This Agreement is effective from June 23, 2022 and will be updated as necessary and/or as a result of changes in current legislation.

2. Terms and definitions

"Administrator" - Charitable Organization, web address https://www.cfpeacefulsky.com/.
"Database" - a collection of information (information, data) in computer files and the Database Management System. 
"Information (information, data) of the Site" is information about the services of the Site, which are entered by Users into the database. 
"Information" - any information, texts, links, graphic, video and audio objects, Materials. 
"User" (or "Users") - any natural/legal person (or programs that allow using the site - "Robots"), regardless of legal status and legal capacity, who use any of the functions or services of the Site.
"Charitable Organization" - the owner of the Site - the Charitable Organization "Charitable Fund "For a Peaceful Sky", in the person of the director Vitaly Oleksandrovych Komarevtsev, address: Ukraine, 03189, city of Kyiv, st. Yaltynska, building 15, apartment 178, EDRPOU code 44671794. 
"Materials" - the text of information (information, data), photos, graphics, messages, audio (video) recordings, program codes, comments and other materials. 
"Network etiquette" - formal rules of behavior, communication, traditions on the Internet, prohibiting, at a minimum, Spam, Flood, Flame, Offtopic and other types of disrespect on the Internet. 
"Registration on the site" (hereinafter also referred to as "Registration") is the process of submitting personal data to the Site in order to further obtain access to the services of the Site's resources, which cannot be used by unregistered Users, in particular, access to the provision of charitable and/or humanitarian aid by the Charity Organization.

3. Restrictions according to the Privacy Policy

3.1. The Site user must comply with the following rules:
3.1.1. not to use the site improperly, not to try to influence or interfere with its operation or to access information other than through a standard interface;
3.1.2. use the site only in accordance with the norms of Ukrainian legislation;
3.1.3. in case of violation of the terms of the Agreement or in case of suspicion of violation of the terms of the Agreement, the Administrator has the right to suspend or completely close the Site User's access to the site at the Site User's IP address.
3.2. The Charity may review and update this Agreement at any time. The Site User is bound by these changes and must visit this page from time to time to review the current version of the Agreement.

4. Rights of the Site User

4.1. The Site user has the right to:
4.1.1. to know the location of the personal data base, which contains his personal data, its purpose and name, location, and/or place of residence (residence) of the owner or manager of personal data, or to give an appropriate mandate to obtain this information to persons authorized by him, except in cases established by law ;
4.1.2. to receive information about the conditions of providing access to personal data, in particular information about third parties to whom his personal data is transferred;
4.1.3. to access your personal data;
4.1.4. to receive no later than thirty calendar days from the date of receipt of the request, except in cases provided by law, an answer on whether his personal data is stored in the relevant personal data base, as well as to receive the contents of his personal data that are stored;
4.1.5. present a reasoned demand to the owner of personal data with an objection to the processing of his personal data;
4.1.6. make a reasoned demand for the change or destruction of your personal data by any owner and administrator of personal data, if these data are processed illegally or are unreliable;
4.1.7. to protect your personal data from illegal processing and accidental loss, destruction, damage, in connection with intentional concealment, failure to provide or untimely provision of them, as well as to protect against providing information that is unreliable or disgraces the honor, dignity and business reputation of a physical individuals;
4.1.8. file complaints about the processing of your personal data to state authorities and officials whose authority is to ensure the protection of personal data, or to a court;
4.1.9. apply legal remedies in case of violation of the legislation on the protection of personal data;
4.1.10. enter a reservation regarding the limitation of the right to process your personal data when giving consent;
4.1.11. withdraw consent to the processing of personal data;
4.1.12. know the mechanism of automatic processing of personal data;
4.1.13. to protect against an automated decision that has legal consequences for him.
4.2. The disposal of personal data of the Site User, who is limited in civil capacity or recognized as incapacitated, is carried out by his legal representative. 

5. Purposes of collecting personal data

5.1. The Charitable Organization collects and uses personal data of the Site User for better provision of voluntary personal and/or property charitable assistance to Site Users and other beneficiaries of such charitable assistance to achieve the goals stipulated by the Law of Ukraine "On Charitable Activities and Charitable Organizations"; for better provision of humanitarian aid to Site Users and other recipients of humanitarian aid in accordance with the Law of Ukraine "On Humanitarian Aid", as well as to:
5.1.1. answer questions and requests;
5.1.2. to process requests and/or statements of Site Users about the provision of charitable and/or humanitarian aid;
5.1.3. regulate or otherwise fulfill their obligations in connection with any contract concluded with the Charitable Organization; 
5.1.4. prevent and solve problems related to the provision of any charitable and/or humanitarian aid provided to the Site User;
5.1.5. promptly respond to possible complaints related to shortcomings in the process of providing charitable and/or humanitarian aid;

5.1.6. perform the functions of a tax agent of the Site Users in the case of providing them with charitable and/or humanitarian aid by the Charity Organization based on the Tax Code of Ukraine;

5.1.7. to carry out accounting of charitable and humanitarian aid, as well as other types of accounting provided for by the legislation of Ukraine regarding the receipt and targeted use of charitable and humanitarian aid;

5.1.8. to submit reports on the availability and distribution of humanitarian aid to the relevant specially authorized state body for humanitarian aid;

5.1.9. to ensure the interests of national security, economic well-being and human rights.

5.2. The Site User gives the Charitable Organization his consent to the processing, collection, registration, accumulation, storage, adaptation, change, renewal, use and distribution (distribution, sale, transfer), depersonalization of personal data, including confidential information about his education, address, date and place of birth, work experience (general, in the civil service and in local self-government bodies). The above information may also be provided to third parties directly involved in the processing of this data, as well as in other cases expressly provided for by law.

5.3. The Site User gives the Charity Organization his consent to the use of personal data of the Site User in the process of cooperation of the Charity Organization with providers/donors of charitable and humanitarian aid, both residents of Ukraine and non-residents, in particular, gives the Charity Organization consent to transfer his personal data to the relevant providers/donors of charity and humanitarian aid, by international organizations in the field of human rights protection in order to improve the quality of the provision of charitable and humanitarian aid.

5.4. Except as provided in this Agreement, the Charity will not disclose any personal information unless the Charity is required to do so by law or if such action is necessary to protect or prevent our rights, property or personal safety.

6. Use of personal information provided on other sites

6.1. There may be links to other sites on the website of the Charity Organization, or the User of the Website may go to the website of the Charity Organization following a link from another website. 
6.2. The Charitable Organization is not responsible for the privacy policies and practices of other sites.

7. Cookie policy, use of Google Analytics

7.1. Cookies are used by the Charitable Organization to operate the website. With their help, it is possible to identify the browser of users who visit our site repeatedly, in these files it is possible to save user settings and other information.
7.2. The Site user can set the browser to reject all cookies or notify about their sending.
7.3. With the help of Google Analytics, the Charity collects statistics about visits to the site, such as visited pages, number of page views, domains, Internet providers and countries of origin of our visitors, as well as addresses of sites visited before and after the site, etc.  

8. Other provisions

8.1. The Charitable Organization takes measures to ensure that the information on this website is reliable. However, the Charitable Organization does not assume responsibility and does not guarantee that the information and data provided are accurate, objective and current at the time of review.
8.2. It is prohibited to distribute, modify, transfer, use or reuse any information from this site for any public or commercial purpose without the written permission of the Charitable Organization. 
8.3. Users can change / delete personal information (phone) at any time. The operation of some features of the Charitable Organization, which require the availability of information about the User, may be stopped from the moment of changing / deleting the information. 
8.4. The User's personal data are stored until the User deletes them. A letter (information) sent to the address of the location of the Charitable Organization according to the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations will be sufficient notification of the User about the deletion or other processing of personal data.

8.5. The user agrees with the Agreement, as well as with the transfer and processing  of data.
The user confirms that he is of legal age, as well as the absence of any acts limiting his legal capacity.
8.6. The Site user has the right to personally learn more about the information stored by the Charitable Organization and make corrections if necessary. The Site user has the right to ask us not to use the information by not giving consent in the registration form.
If the Site User has additional questions that are not disclosed in this Agreement, the Site User can send a letter to the address: Ukraine, 03189, city of Kyiv, str. Yaltynska, building 15, apartment 178.
